South Africa strengthens lottery grant oversight as tribunal orders repayment of unlawful US$223,000 grant

South Africa has reinforced oversight of lottery-funded projects after the Special Investigating Unit (SIU) secured a ruling from the Special Tribunal ordering the repayment of an unlawfully awarded R4m (US$223,000) grant issued by the National Lotteries Commission.

In a judgment dated July 13, the Tribunal declared the grant awarded to the Mshandukani Foundation unlawful, setting aside the decision and ordering full repayment with interest. The ruling follows an SIU investigation that uncovered fraudulent misrepresentation and misuse of funds linked to the grant.

The Tribunal directed the foundation and associated individuals to repay the amount jointly and severally, with interest accruing at 10.75 per cent per annum until settlement.

According to the SIU, the grant application was based on a project that had already been completed several years earlier, misleading the commission into approving funding. The investigation also revealed that a significant portion of the funds was diverted to entities linked to individuals associated with the foundation.

The original application, submitted in 2019, sought funding for a community borehole project in the Eastern Cape, claiming it would provide clean water to over 8,000 beneficiaries and create employment opportunities. However, evidence presented during the investigation confirmed that the infrastructure had already been completed in 2016.

Further findings showed that most of the funds were redirected to third-party entities, including construction and related businesses with

The National Lotteries Commission supported the SIU’s application and did not oppose the proceedings, reinforcing the regulator’s commitment to strengthening accountability and transparency in the allocation of public funds.

The ruling highlights South Africa’s ongoing efforts to combat corruption, recover misused public funds, and enhance governance within the lottery sector. It also signals a broader push to ensure that lottery funding is directed toward legitimate community development initiatives and managed in line with strict regulatory standards.
